　　中新网北京4月24日电 (记者 孙自法)国家知识产权局局长申长雨4月24日透露，国家知识产权局会同中央宣传部、最高人民法院、最高人民检察院、公安部、司法部、商务部、海关总署、国家市场监管总局等8部委共同完善知识产权保护体系，正在加快制定出台知识产权保护体系建设工程实施方案，聚焦知识产权保护方面的短板弱项，方案从政策标准、授权确权、执法司法、保护管理、社会共治、安全治理、能力支撑等七方面提出一系列有力措施。

　　国务院新闻办公室当天在北京举行介绍2023年中国知识产权强国建设有关情况新闻发布会，申长雨回答媒体相关提问时作上述表示。他说，这是今年知识产权保护方面的一项重点工作，目前，知识产权保护体系建设工程实施方案已完成部门会签，将于近日发布实施。

　　申长雨举例介绍其中五项举措说，针对侵权易发多发问题，方案提出严厉打击侵权假冒违法行为，对故意或重复侵犯专利权，拒不履行生效行政裁决等行为的，依法引入联合惩戒、信用监管等措施。

　　针对维权周期长问题，方案从司法保护的角度提出加强知识产权法院和知识产权法庭建设，从行政保护的角度提出加强快速维权保护机制建设，在缩短知识产权授权周期的同时，开展纠纷快速处理试点，发挥调解组织、仲裁机构、公证机构的重要作用，提高纠纷解决效率。

　　针对维权成本高问题，强化行政机关与司法机关的协同联动，探索依当事人申请的知识产权纠纷行政调解协议司法确认制度，鼓励各地积极开展公益性维权援助，降低维权成本。

　　针对侵权赔偿低问题，深化国家层面上诉审理机制，全面实施侵权惩罚性赔偿制度，完善侵权“数额计算”等裁判标准。

　　针对举证难问题，完善侵权损害赔偿的证据规则，加强技术调查人才培养，在知识产权行政裁决、行政执法、司法审判等案件处理中引入技术调查官。

　　他希望通过知识产权保护体系建设工程的实施，推动提高知识产权保护的体系化、专业化、便利化水平，进一步夯实知识产权保护的基础，更好塑造良好的创新环境和营商环境。

　　回应关于中国企业在海外知识产权合法权益保护的提问时，申长雨强调，知识产权是企业国际竞争力的核心要素，越来越成为国际竞争的焦点。近年来，国家知识产权局采取有力措施，帮助中国企业维护海外知识产权合法权益。

　　他说，国家知识产权局会同中国贸促会设立国家海外知识产权纠纷应对指导中心，并已在27个省(区、市)布局建设43家地方分中心，在贸易往来密集的国家和地区设立工作指导站，为企业提供专业高效的海外维权指导服务。仅2023年，就指导企业1706家，帮助企业挽回经济损失68.9亿元人民币，帮助企业降低维权成本3.9亿元人民币。同时，国家知识产权局还不断加强海外知识产权信息收集和供给，利用“智南针”网络平台定期发布重点国家和地区的知识产权法律制度规定和风险预警信息，帮助企业及时了解有关情况。

　　申长雨表示，下一步，国家知识产权局将和相关部门一起，进一步加大知识产权海外维权援助工作力度，完善相关制度机制：一是继续布局建设更多国家海外知识产权纠纷应对指导中心，设立更多海外工作站点，并加大涉外知识产权律师的培养，提升企业海外纠纷应对指导的可及性和便利度。二是继续加强对跨境电商、“337调查”、标准必要专利、商标抢注等重点问题的专业指导，鼓励有条件的地区设立海外知识产权维权援助基金，支持保险机构开发推出更多海外知识产权保险产品。三是继续加强“智南针”网络平台建设，不断丰富海外知识产权制度规则收集分享和风险预警信息供给，做好纠纷应对经验总结和典型案例发布，并加大向企业的推送力度。(完)
