中新网郑州4月25日电 (记者 刘鹏)知识产权作为国家发展战略性资源和国家竞争力核心要素，对推动高质量发展具有关键引领作用。25日，河南省政府新闻办通报了该省近年来加强知识产权司法保护的工作情况，并对受理案件的主要特点进行通报介绍。
当日发布会上，河南省人民检察院副检察长牛晓丽称，2021年至2023年，河南全省检察机关共受理侵犯知识产权审查逮捕案件1278件2606人，批准和决定逮捕753件1267人，共受理审查起诉侵犯知识产权犯罪案件1658件3860人，提起公诉1335件2957人。共受理知识产权民事诉讼监督案件81件，受理知识产权行政诉讼监督案件5件，办理知识产权公益诉讼案件14件，办理知识产权综合履职案件53件。
牛晓丽介绍，这些案件的主要特点包含多个方面。一是罪名分布相对集中、侵权对象范围较广。以侵犯商标类和著作权类犯罪案件为主，侵权物品涉及日常生活消费的多方面，如食品、烟酒、服饰、板材、电源电器、农药兽药、盗版教材、图书等。
二是犯罪网络化、链条化、产业化特点突出。互联网文学、音乐影视、游戏、动漫、软件等领域网络侵权盗版不断增多，侵权作品多以开设公众号、多平台侵权、捆绑销售等形式传播。共同犯罪案件增多，形成“线上+线下”犯罪产业链。
三是侵犯软件著作权已成为侵犯知识产权犯罪的新形态。私服游戏、通讯科技、自动化经营、手机app等领域犯罪高发，有一些侵权软件还被不法分子作为犯罪工具用来进一步实施其他犯罪行为，延伸了犯罪链条。
四是侵犯商业秘密犯罪更加多元化复杂化。商业秘密作为企业的核心竞争力，凝聚了企业在社会活动中创造的智力成果，关系到企业生存与发展，跳槽员工带走商业秘密、骨干人员另立门户、内部职员外卖商业秘密等占据主要作案方式。
牛晓丽介绍，近年来，河南全省检察机关聚焦地理标志产品、传统文化、民间艺术、老字号、非物质文化遗产等重点领域，有序开展知识产权公益诉讼，办理了一批有示范引领作用的典型案例，为传统文化和经济发展提供法治保障。
通报称，为进一步适应新时代知识产权检察工作要求，更好回应人民群众关切，河南省人民检察院编写了《河南省知识产权检察白皮书(2021-2023)》(简称《白皮书》)，并和河南省高级人民法院联合编发了2023年度知识产权司法保护典型案例。《白皮书》分为四个部分，包括河南省检察机关知识产权检察工作情况、工作机制、经验做法、典型案例等。(完)
