中新网4月23日电 据国家药监局网站消息，各级药品监督管理部门深入贯彻落实党中央、国务院有关加强药品安全工作的决策部署，持续加强药品监督管理，扎实推进药品安全巩固提升行动，严厉打击药品网络销售违法违规行为，切实保障人民群众身体健康和用药安全。现将第五批药品网络销售违法违规典型案例公布如下：
一、京东商城入驻商家违规销售处方药案
2023年3月，广西壮族自治区富川县市场监督管理局根据投诉举报线索，对富川千年健大药房进行调查，发现该药房通过京东商城销售处方药健兴肺力咳合剂时，处方来源不真实。
当事人上述行为违反《药品网络销售监督管理办法》第九条第一款规定。富川县市场监督管理局依据《药品网络销售监督管理办法》第三十四条第一款和《广西壮族自治区药品监管行政处罚自由裁量权适用规则》第八条第四款规定，责令当事人改正违法行为，并处以罚款0.5万元的行政处罚。
二、饿百网入驻商家违规销售处方药案
2023年3月，四川省广安市广安区市场监督管理局对广安正和祥药业连锁有限公司万盛店进行现场检查，发现该药店通过饿百网销售肾石通颗粒等药品时，药师未在处方上复审签字，存在处方重复使用的风险。
当事人上述行为违反《药品网络销售监督管理办法》第九条第二款规定。2023年3月，广安市广安区市场监督管理局依据《药品网络销售监督管理办法》第三十四条第一款和《四川省药品医疗器械化妆品行政处罚裁量权适用规则》第九条第(八)项的规定，责令当事人改正违法行为，并处以罚款0.2万元的行政处罚。
三、“本草铺网上中药店网站”入驻商家销售医疗用毒性药品案
2023年1月，福建省漳州市市场监督管理局根据国家药品网络监测平台移送信息线索，对漳州老瑞林药店连锁有限公司新城佳园分店进行调查，通过“本草铺网上中药店网站”销售禁止网络销售的医疗用毒性药品“雄黄”，且无法提供购进记录等材料。
当事人上述行为违反《中华人民共和国药品管理法》第五十七条、《医疗用毒性药品管理办法》第五条、《药品网络销售监督管理办法》第八条第二款规定。2023年3月，漳州市市场监督管理局依据《中华人民共和国药品管理法》第一百三十条规定、《医疗用毒性药品管理办法》第十一条、《药品网络销售监督管理办法》第三十三条规定，责令当事人改正违法行为，并处以警告、没收“雄黄”108g、罚没款5.02万元等行政处罚。
四、药房网入驻商家非法渠道购进药品案
2023年6月，重庆市璧山区市场监督管理局依法对重庆市璧山区桐君阁皓轩药房进行日常检查，发现该药房通过微信从个人李某某处购进阿利沙坦酯片等药品，再通过药房网销售，且该药房购进药品时未查验对方资质、未索取药品票据及随货同行单据。
当事人上述行为违反《中华人民共和国药品管理法》第五十五条规定。2023年8月，璧山区市场监督管理局依据《中华人民共和国药品管理法》第一百二十九条和《重庆市规范行政处罚裁量权办法》第十四条第一款规定，责令当事人改正违法行为，并处以罚款4万元等行政处罚。此外，本案中关于李某某涉嫌的违法行为，已另案处理。
五、美团平台入驻商家无证经营药品案
2023年6月，江西省南昌市市场监督管理局根据投诉举报线索，对江西省甄康电子商务有限公司进行现场检查。经查，该公司在未取得《药品经营许可证》情况下，通过美团平台开设“甄康医疗器械专营店”，销售贝复舒牛碱性成纤维细胞生长因子滴眼液等药品。
该公司上述行为违反了《中华人民共和国药品管理法》第五十一条第一款规定。2023年11月，南昌市市场监督管理局依据《中华人民共和国药品管理法》第一百一十五条和《江西省药品监督管理行政处罚裁量权适用规则》第九条第一款第二项的规定，对当事人处以罚款20万元等行政处罚。

消费者通过网络购买药品时，请关注两个资质：一是药品零售企业资质，网站首页或者经营活动的主页面显著位置是否公示《药品经营许可证》；二是药品资质，所购买药品是否取得国家药品监督管理局核发的《药品注册证书》。请勿通过社交软件、短视频内容发布平台等渠道，从无资质的商家或者个人处购买药品。
从事处方药销售的药品网络零售企业和第三方平台向个人销售处方药，应确保处方来源真实可靠，并实行实名制。药品网络零售企业还应当建立在线药学服务制度，由依法经过资格认定的药师或者其他药学技术人员开展处方审核调配、指导合理用药等工作，同时应对已经使用的电子处方进行标记，避免处方重复使用。
疫苗、血液制品、麻醉药品、精神药品、医疗用毒性药品、放射性药品、药品类易制毒化学品等国家实行特殊管理的药品不得在网络上销售，具体目录详见《国家药监局关于发布药品网络销售禁止清单(第一版)的公告》。
