　　中新社北京4月19日电(记者 张素)记者19日从中国最高人民检察院获悉，今年前三个月，全国检察机关在民事诉讼监督中发现存在虚假诉讼问题的有1885件，一些违法行为人通过虚假诉讼、虚假劳动仲裁骗取套取国家养老保险金。

　　检察机关研判概括出案件呈现的主要特征。其中，一些违法行为人通过虚构劳动关系进行虚假诉讼，或利用虚假劳动仲裁申请确认虚假劳动关系，以满足一次性“补缴”养老金的既定条件，进而获取本不应由其享有的养老保险待遇。

　　检察机关还发现一些案件有违法中介“职业化”参与，甚至形成产业链。所谓“中介人员”为谋利，与违法行为人恶意串通，帮其寻找“虚构劳动关系”目标单位，伪造工资条、劳动合同等证明材料，为实施虚假诉讼或虚假劳动仲裁出谋划策。有的直接参与、充当虚假诉讼的当事人，甚至勾结有关人员进行非法操作。

　　部分社保领域虚假诉讼或虚假劳动仲裁易衍生刑事犯罪。在刘某等27人虚假诉讼监督系列案中，检察机关查办纠正了错误民事判决。收取“中介费”的张某等人被以虚假诉讼罪提起公诉。

　　最高检强调，任何违法违规骗取或套取社保基金的行为都将受到法律严惩。一方面，检察机关将持续加大对社保领域虚假诉讼个案、系列案件的查办力度；另一方面，检察机关将联合法院、劳动仲裁机构等共同堵塞社保基金监管漏洞，规范补缴社保流程。(完)
