  中新网西安4月26日电 (杨英琦)《陕西省知识产权保护和促进条例》(以下简称:条例)于26日起正式施行。该条例的制定,是陕西推进西部示范知识产权强省建设,加快新质生产力发展的重要保障。

  近年来,陕西省知识产权事业取得了明显进步,但仍存在整体质量不高、运用效益不佳、协同保护机制不完善、公共服务能力水平不足等问题。该条例对陕西知识产权工作体系、机制和政策措施进行了完善优化,确保各项制度有法可依,有效推进该省知识产权领域治理体系和治理能力现代化。

  据了解,条例于3月26日经陕西省十四届人大常委会第九次会议表决通过。条例分为总则、知识产权创造与运用、知识产权保护、知识产权服务与管理、法律责任、附则,共6章62条。

  条例主要内容包括依法保障知识产权工作在相关领域整体推进,促进知识产权高质量创造与运用。条例支持和鼓励知识产权各类客体的高质量创造运用和创新发展,建立完善相关激励、保障机制。陕西鼓励各地区、各部门结合实际情况,积极探索支撑创新发展的知识产权运行机制,推动建立老字号名录管理机制,支持版权交易平台、知识产权交易市场体系建设,鼓励金融机构为中小企业提供知识产权金融服务等。

  条例明确实行全面、严格、高效的知识产权保护。着力构建保护与促进并重的知识产权制度体系,为各类型知识产权提供“全链条保护”。条例明确要求建立行政保护与司法保护、政府监管与行业自律、企业自治与社会监督相结合的知识产权保护体系,并建立健全新技术、新产业、新业态、新模式知识产权保护规则,强化信用监管和数据知识产权保护等。

  陕西省人大法制委主任委员、常委会法工委主任王占峰表示,条例结合陕西实际,围绕现实需求,满足创新主体对加强知识产权保护的诉求,推动解决知识产权整体质量效益不高等实际问题;通过规范政府和相关部门在知识产权管理保护和促进方面的职能,构建起相对完善的保护体系和服务体系,对于激发社会创新活力,促进陕西省知识产权的创造与运用,将该省打造成知识产权强省,推动高质量发展,具有十分重要的意义。(完)
