　　中新网4月25日电 据农业农村部网站消息，农业农村部、公安部、中国海警局近日联合发布《关于开展2024年海洋伏季休渔专项执法行动的通知》(以下简称“通知”)，决定自2024年5月1日至9月16日开展海洋伏季休渔专项执法行动(以下简称“专项行动”)。

　　行动任务方面，通知提出，一是协同联动强化船籍港休渔管理。以县(市、区)为单位建立应休渔渔船名册，落实依港管船、定人联船、船位报告、定期点验、信息周报等制度，督促应休渔渔船返回船籍港休渔。因特殊原因确实不能回船籍港休渔的，按照“谁批准、谁负责，谁收留、谁监管”的原则，由船籍港所在地省级渔业渔政主管部门协调拟靠泊休渔渔港所在地渔业渔政主管部门履行监管责任，建立异地休渔渔船共管机制，切实做到“船回港、人上岸、网入库”。

　　二是持续发力抓好专项(特许)捕捞监管。按照2024年海洋伏季休渔期间特殊经济品种专项(特许)捕捞许可和捕捞辅助船配套服务安排的有关要求，落实专项(特许)捕捞渔船标识管理、船位动态监控、进出渔港报告、渔获物定点上岸、限额捕捞等制度，确保专项(特许)捕捞制度平稳有序实施，在不影响海洋伏季休渔秩序前提下，科学利用特殊经济品种资源。继续加大对东海区桁杆拖虾、笼壶类、刺网和灯光围(敷)网等四种作业类型渔船专项(特许)捕捞执法检查力度，重点盯防因严重违反海洋伏季休渔相关规定被查处的渔船，严厉打击未办证出海作业、违反专项(特许)捕捞许可证规定作业等违法违规行为。加强对海洋渔业资源调查活动的监督管理，重点检查持证作业、船位监测设备使用等情况，督促其严格执行相关管理制度，确保渔获物按照要求妥善处置，防止流入市场。

　　三是以巡促防开展海上常态化检查。统筹执法力量，落实常态巡航要求，扩大巡逻防控区域，加强进出港通道管控和重点海域巡查，不定期组织开展交叉检查、突击抽查和区域联查，做到管控无漏洞，打击无盲区。加大现场登临检查力度，对海上发现正在作业的涉渔船舶应登尽检，查获的涉渔违法违规船舶依法从严处罚；无法登临检查的，要留存足以反映违规涉渔船舶特征和信息的证据，及时通报有关部门依法核查处理。

　　四是多措并举加强重点水域管控。加强对群众举报集中、非法捕捞多发频发区域以及长江口、北纬26度30分线、北纬35度线和底拖网禁渔区线附近海域等重点区域的执法监管，严厉打击违规跨区跨线作业以及规模性、群体性非法捕捞活动。加强对涉韩朝、涉日、涉越等涉外敏感海域巡逻管控，严防我渔船非法越界(线)捕捞。加强北部湾我方一侧、海南岛周边等外籍渔船侵渔高发海域巡航执法，综合运用行政和司法等手段，有力震慑外籍渔船侵渔行为。

　　五是追踪盯紧重点船舶和特殊群体。加强对违法违规行为易发多发对象的监管，重点盯防异地休渔渔船、捕捞辅助船、乡镇船、“拖改刺(围)、拖(围、刺)改钓”渔船、法院扣押渔船等重点涉渔船舶，以及曾因涉渔活动被追究刑事责任或近两年内因违反海洋伏季休渔规定被行政处罚的船长、船东、企业负责人等从业人员，要做到底数清、情况明、动态准。对养殖渔船、钓具渔船、休闲渔船等不休渔船舶要加强日常监管，防范其改变生产作业方式从事非法捕捞活动。

　　六是以岸控海强化渔港码头监管。加强渔港码头巡查和坞修渔船管理，定期核查船舶数量和信息，利用渔船渔港动态监控系统实施24小时监控巡防，及时掌握船舶动态。发现违规出海作业的，要及时召回并依法从严处罚。发现非法补给、渔获物运输、交易等行为的，要及时制止并依法严肃处理。要利用休渔有利时机集中组织封港清船，加强对涉渔“三无”船舶的摸排清理，溯源倒查船舶修造等环节，配合有关部门查处非法修造船舶行为。

　　七是严厉打击快艇涉渔违法活动。加强对水生生物“三场一通道”、增养殖水域、海洋牧场、易隐匿锚泊点等重点水域的巡航值守，精准打击快艇携带网具出海、非法捕捞、盗采养殖水产品、靠泊卸载非法渔获物等行为。坚持“海陆并重、守株待兔、露头就打”，在重点港口、停泊点派驻执法力量进行常态化值守，以驻点港口为中心对整个岸线开展全覆盖巡查，并根据线索对偏远港口码头停泊点、存在监控盲区的岸线等重点区域实行定点蹲守，第一时间查处违法行为。

　　八是串并深挖打击涉渔犯罪行为。紧盯涉渔重点地区、部位、船舶和人员，加强基础信息摸排和情报信息搜集研判，及时发现海上非法捕捞和非法越界(线)捕捞的情报线索，集中精力查办一批海上非法捕捞大案要案。对涉嫌组织化、团伙化的案件，按照“破现案、挖源头、断链条、打外围”相结合原则，聚焦港口、船厂、市场、补给、海上等全过程、全环节，实现全链条打击整治；对发现的海霸渔霸及非法捕捞的幕后组织者、黑中介等从严惩处；对渔民个人情节轻微的非法捕捞行为，以教育引导为主、打击整治为辅，实行宽严相济的刑事司法政策。

　　工作要点方面，通知明确，5月1日至5月15日，各地渔政、海警舰船应出尽出，开展全海域、大规模、高密度的巡逻巡查，形成初始即严的执法态势。

　　8月1日至9月16日，开展对北纬35度至北纬26度30分之间海域桁杆拖虾、笼壶类、刺网和灯光围(敷)网等四种作业类型渔船专项监管。

　　8月16日至9月16日，开展北纬26度30分附近海域集中管控行动。

　　9月1日至9月16日，开展北纬35度附近海域集中管控行动。

　　开渔前，联合开展港口码头巡查走访，加强普法宣传和安全教育，排查安全隐患并督促整改，确保船舶安全出海航行作业。其余时间段，落实常态化管控要求，并根据海上态势适时组织开展涉外渔业集中管控行动，严打涉外敏感海域非法捕捞和外籍渔船侵渔活动。
